SongSeek (operated by Meggy Labs LLC) respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), SongSeek will respond promptly to claims of copyright infringement committed using the SongSeek service that are reported to our designated copyright agent identified below.

If you believe your copyrighted work has been infringed

To file a notice of copyright infringement, please send a written communication to our designated agent that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit SongSeek to locate the material. (A direct URL to the post or comment is best.)
  4. Information reasonably sufficient to permit SongSeek to contact the complaining party, such as an address, telephone number, and email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices that do not comply substantially with the requirements above may not receive a response. Misrepresentations in a takedown notice may subject you to liability under 17 U.S.C. § 512(f).

Counter-notification

If you believe your content was removed in error or that you have authorization to use the content (for example, fair use, license, or as the rights holder yourself), you may submit a counter-notification to our designated agent. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which SongSeek may be found, and that you will accept service of process from the person who provided the original notice or that person's agent.

Upon receipt of a valid counter-notification, SongSeek will forward it to the original complaining party. Unless the complaining party files an action seeking a court order against you within 10 business days, SongSeek may restore the removed material.

Repeat infringer policy

SongSeek will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. A user with three or more valid copyright takedowns against their content within a 12-month period will be considered a repeat infringer and subject to permanent account termination at our discretion.

What SongSeek does on receipt of a valid notice

  • We promptly remove or disable access to the allegedly infringing material.
  • We notify the user who posted the material that it has been removed and provide them with a copy of the takedown notice.
  • We track the takedown against the user's account for purposes of our repeat-infringer policy.
